Terms of Service

These are general terms for use of smartersweb.tech and for inquiries made through this site. A signed proposal, statement of work, estimate, invoice, order, or other written agreement may add to or replace these terms for a specific engagement. If there is a conflict, the project-specific written agreement controls.

Website use

You may use this website for lawful business and informational purposes. You must not attempt to disrupt the site, bypass access controls, submit malicious content, probe protected systems without authorization, or misuse forms and support channels.

Services and scope

Website development, WordPress, WooCommerce, redesign, maintenance, SEO implementation, training, SmarterSUITE work and related services are provided only to the extent described in an agreed scope. Features shown on examples or industry concept pages are not automatically included in every project.

Estimates, pricing and payment

Prices displayed on a page are only binding when they clearly apply to the selected service and are confirmed in the applicable order or agreement. Custom work is quoted based on scope. Deposits, milestones, taxes, payment methods, cancellation terms and due dates are confirmed in writing for the engagement.

Client responsibilities

Clients are responsible for providing accurate requirements, timely feedback, required access, lawful content, licences for supplied materials, and approvals needed to complete the work. Delays in access, content or approvals can affect delivery dates.

Third-party services

Projects may depend on hosting providers, domain registrars, payment processors, plugins, APIs, analytics services, email platforms, fonts, stock assets or other third-party products. Their availability, pricing, security, licences and terms are controlled by those providers unless a written agreement states otherwise.

Intellectual property

Client-provided content remains the client’s responsibility and property. Ownership or licensing of custom deliverables is defined by the project agreement. Pre-existing SmartersWEB Tech tools, reusable methods, templates and know-how remain separate unless expressly transferred. Third-party materials remain subject to their licences.

Testing, acceptance and revisions

Testing and acceptance criteria are defined by scope. Reasonable fixes for defects against the agreed deliverable are different from new features or scope changes. Additional work may require a revised estimate or change order.

No outcome guarantee

Unless a specific written service level says otherwise, SmartersWEB Tech does not guarantee search positions, traffic, conversion rate, revenue, uninterrupted third-party services, or other business outcomes. Technical work is performed against documented requirements and reasonable professional standards.

Backups and production changes

Where SmartersWEB Tech is responsible for a deployment, reasonable backup and rollback steps should be agreed before material production changes. Clients should also maintain appropriate independent backups of business-critical systems and data.

Confidentiality and credentials

Access credentials and non-public client information supplied for a project are to be used only for authorized work. Clients should provide the minimum access necessary, use secure credential-sharing methods where available, and revoke or rotate temporary access when it is no longer needed.

Limitation and project-specific terms

Any warranties, indemnities, liability limits, refunds, service levels, dispute procedures or governing-law clauses that materially affect a paid engagement should be set out in the applicable written agreement. Nothing on this page excludes rights or obligations that cannot legally be excluded.

Changes

These website terms may be updated as the site, services or legal requirements change. Material project terms already agreed in writing are not changed merely by updating this webpage.
